Know Respect

By now, everyone is aware of the Union’s strong objection to the Retreat’s CEO, Rob Simpson, giving $100 more in bonus money to non-union staff and restoring earned time to non-union staff months before union staff after telling our negotiating team he could not afford a penny more. In our view, this issue is far greater than a simple disagreement over a contract issue. The disagreement gets to the foundation of how our CEO views our work and our important contributions.
Good relationships, whether they be labor relationships, patient/staff relationships, supervisor/staff relationships or any other positive relationships are founded on mutual respect and honesty. In the past and currently, our Union has very good working relationships with many in supervisory and managerial positions. We are proud of those relationships and we believe that everyone, staff, patients and mangers have benefited from them. The underpinning of those positive and productive relationships has been honesty and mutual respect. Certainly we have had many disagreements and we will continue to have them. What has held us together is an ongoing honesty in working with one another and mutual respect.
So it continues to alarm us that respect and honesty is missing from the front office, the office of the Retreat’s CEO. It is not honest to tell the Union negotiating team, representing all of you, that there is not a penny more and then give more to others. It is not respectful to, for the first time in anyone’s memory, reward one set of employees more than another simply on Union status. We want to be very clear on this point. We support the idea that everyone be treated fairly and that everyone be rewarded for their contributions to the Retreat, union and non-union alike. But it is very disrespectful and unfair to pay front line staff less than supervisors, administrators and other non-union staff.
In this coming year, we are committed to fighting for all members to assure that we are all dealt with both individually and as a Union with the respect and dignity we have all earned and deserve.

Democrats vie early for labor support

FAIRLEE -- Four of the five prospective Democratic candidates for governor came to the Lake Morey Resort on Saturday to court delegates representing the 9,500-members of the Vermont AFL-CIO -- even though the primary and general elections are months away.
The delegates didn't mind. Unions want to hear from potential candidates early, said Jill Charbonneau of Middlebury, Vermont AFL-CIO executive vice president. "We want to have our voice shape their campaigns."
As a result, the 53rd convention for this association of unions featured a parade of politicians including four Democratic gubernatorial aspirants -- Former Sen. Matt Dunne, Sen. Doug Racine, Sen. Peter Shumlin and Secretary of State Deb Markowitz. Sen. Susan Bartlett, who has launched a gubernatorial campaign, too, was scheduled to appear but canceled because of illness.
The union group also heard words of advice from Progressive Anthony Pollina, the gubernatorial candidate the AFL-CIO endorsed in the 2008 election. He said he has yet to decide whether he will run for statewide office in 2010, but he had plenty to say about how labor ought to measure the candidates seeking their votes, money and campaign support.
"How popular you all are going to be in the next few months because you have power," Pollina told the 50 delegates at the convention. Looking to the back of the room where a couple of the Democratic rivals stood, Pollina said, "They want your credibility. They want you to empower them."
"Don't give away that power too quickly," Pollina said. He suggested waiting until after the Legislature adjourns, noting that three of the five serve in the Senate. "See what these people are able to do."
Pollina suggested the AFL-CIO could make some demands now. For example, he said one litmus test would be to see what happens to S.88, a bill to create a single-payer health system in Vermont. The bill received no consideration last winter even though half the Senate has signed on as sponsors.
"That bill should have passed yesterday," Pollina said. He noted that two senators running for governor aren't sponsors of S.88 -- Racine and Bartlett. Shumlin is a sponsor.
Earlier Saturday, Racine had promised the delegates the health care bill would be taken up in the committee he chairs in January -- which drew applause. He didn't promise passage and cautioned, "There are a lot of issues to be worked out. It is not going to be easy."
Racine had come to renew his relationship with the AFL-CIO. He reminded the crowd he had enjoyed their support in past elections. "I have always been there for labor in this state," he said.
Acknowledging his Democratic competition, Racine said, "A lot of us are going to be talking to you and sort of saying the same thing." He urged people to consider his record.
All four candidates spoke of their "vision" for the state. Racine said he was on a "mission to restore the middle class to this state."

Racine was on another mission, too. He was wooing the Vermont Progressive Party.
"If you get their support," he said, referring to the union association, "it means you are looking out for working Vermonters. It carries beyond the union. It would help me earn the support of Progressives."
Dunne, the first potential gubernatorial candidate to speak, was the first to talk about the shrinking middle class. "The challenge that we face together," he said, "is investing in building our middle class."
Dunne hasn't formally announced his candidacy. "I'm being encouraged to jump into the race," he said, telling the crowd that some among them had urged him to run. He expects to announce his decision in November.
The youngest of the Democratic gubernatorial aspirants, Dunne mentioned several times that "Vermonters are clearly hungry to know what the next era is."
Shumlin, who has also yet to confirm his candidacy, nevertheless gave a classic stump speech. He outlined what the Legislature did for labor last session to protect unemployment insurance, to go after employer fraud in workers compensation and to insist on fair wages in the economic stimulus projects.
He made a political promise -- that whatever remedy was found for the looming deficit in the unemployment insurance fund, "We will not reduce benefits."
Shumlin also offered his strategy for reviving the Vermont economy -- focus on businesses that wean the state from fossil fuels. "I believe I have the vision and understanding to help get us there," he said.
Shumlin acknowledged his potential Democratic competitors around the room. "Anyone of them would make a wonderful governor," he said.

"We've got to win this election," Shumlin added, warning his rivals that "anyone who criticizes the others deserves to lose."
Markowitz spoke last. "Those of us who are running are old friends," she said. "On the issues, I don't think we are going to differ that much."

She suggested she had a record of bringing people together to find solutions. She sent a little dart toward her rivals in the Legislature concerning their budget squabble with Gov. Jim Douglas, which led to a veto.
"The veto override works. We got a budget, but I don't think very many Vermonters were happy with that," Markowitz said.

She reminded union members that she stood out in the cold with nurses when they organized at Copley Hospital in Morristown. She also recalled how she worked with unions to educate workers about early voting so they wouldn't lose out on their chance to cast ballots if they worked on Election Day.
Ben Johnson, a librarian at Vermont Technical College and an officer in United Professionals, American Federation of Teachers Vermont, said he appreciated Pollina's advice.
"What resonated with me was his advice to keep the bar high and to see that we aren't taken for granted," Johnson said. "We keep, as unions, giving money to campaigns. We have to be sure we support people who support us."

There is another meeting with management to discuss the staffing grids on Tuesday 10-20-09 at 1 pm. Management wants to be able to change the grid whenever they like. We say NO the that.
We have worked hard to have staffing grids in our contracts and we are not about to give them up!

Each Local is entitled to send delegates to the convention ( one delegate for every 25 members). Once again management is not following the contract. They are not following the staffing grids that clearing state minimum staff. The grids are there for both Patient as well as Staff safety. We fought hard to get staffing grids in the contract and we will not allow them to be disregarded by management. Management can always staff up just not at the cost of a union member!

Joint Executive Council meeting

MATT SCHIBLEY (Social worker rep.) and I went to Rode Island on Wednesday March 11 to attend the Joint Executive Council meeting of UNAP. It was good to have somebody besides myself go to the meeting. I think the meeting gave Matt a new perspective on the Union. We sometimes forget we are a part of a larger organization and this becomes apparent at the monthly Executive council meeting.
Sitting around the table with all the others presidents of the many other locals gives one a new appreciation of the fact that we are one local of many. Even with this you begin to understand that we all are struggling against the same thing, Management that can at times become out of control. It is good to know that in these times of economic crisis we are part of a UNION and we have rights guaranteed by our collective bargaining agreement, our contract.

Meal and Rest Breaks

We seem to be having trouble getting breaks. So we have posted the section of the contract on this page so you will know your rights under the contract.

Section 14.2 - Rest And Meal Periods

Employees scheduled to work a shift of six (6) hours or more, or two consecutive six (6) hour shifts, will be entitled to a one-half hour unpaid meal period for each shift. The one-half hour unpaid meal period shall be scheduled first considering patient care needs and then employee preference.

Rest periods fifteen (15) minutes shall be given as scheduled by the Hospital in each one-half (4-hour) tour of duty.

Regarding Meal and Rest Breaks:

Management is willing to be flexible in assigning meal and break times including the ability to combine meal and rest breaks into a single break at any time during the shift. It is understood that individual program managers/supervisors will solely determine when and if such flexibility can occur. Further, Management in no way guarantees that such practice will continue. The union agrees that such practices are not guaranteed, that not all individuals are guaranteed this flexibility and that not all programs can or will schedule in the same manner. Management will not exercise this flexibility in an unreasonable manner. This flexibility agreement and/or the hospital’s exercise of its judgment hereunder is not grievable.

The executives of the union held a union membership meeting on September 2nd to discuss safety and communication issues. During the meeting, members spoke about how imperative it is to keep members informed on latest news and current updates regarding these issues. We discussed different avenues of communication. One thought was to email union members however; we are requesting feedback from the members regarding email. Would members feel comfortable with this avenue? As you know, Tom Flood union president union 2 has tried to rectify this communication issue by starting a Unap blog along with a quarterly news letter which has been posted in the bulletin boards. Tom also started a communication committee. We are trying really hard to rectify past communication issues. We want all union members to be informed as to what is going on. We have had few responses to information that has been delivered. Please let us know what your thoughts are on providing your email to us and other avenues of communication you might have. You may contact the members below.

It seems that the Acuity of the units has gone up in the past few weeks and units are beginning to feel uneasy. Staff have been assaulted by patients and sent to the hospital with a number of injuries. Patients are feeling unsafe and staff feels unsafe at times and also feels unable to deal with the increase in raging, acting out patients lately. More codes are being called and the code themselves are more intense. STRESS levels are at an all time high.
Be careful out there and keep an eye out for your co-workers. We are in this together so let’s work together. Remember to report all unsafe conditions!

New Contract for Our Lady of Fatima Hospital

The United Nurses & Allied Professionals (UNAP), Local 5110, represents about 300 registered nurses at Our Lady of Fatima. Members voted 200 to 3 to ratify the agreement, which includes raises that will amount to 15 percent over the contract’s term; increases in shift-differential and on-call pay; dental coverage; a prescription-drug benefit; and tuition assistance, UNAP said.
“We set two goals for ourselves in this round of negotiations: to improve staffing and to secure a competitive wage and benefit package,” Lynn Blais, a registered nurse and the president of UNAP Local 5110, said in announcing the contract’s ratification. “With the unwavering support of our membership, we were able to approve both.”
Staffing levels had been a sticking point in the longrunning negotiations, the union noted. The new “groundbreaking” agreement will give nurses at Fatima “the right to appeal to a neutral arbitrator if the hospital continues to staff fewer nurses than the numbers that they have reported to the [R.I.] Department of Health, except in limited extenuating circumstances,” UNAP said.

I was given a pin to wear today from my manager that read "Mental Health Worker" and I explained it is something that we would not allow a patient to have since it is a sharp yet Management wants us to wear them anyway! If I am not mistaken my swipe card already has "Mental Health Worker" on it in bold letters!
It appears that the more management say they want to have a safe work environment the less it becomes safe. Pins on units where patients are not allowed to have staples seems very strange. Does this sound safe to you? It sure doesn't to me!

Meeting with Management Revisited

Union officials met with Management on Thursday August 21,2008 with some results to show. Both sides will do some research and get back to each other by September 5.
There was no results on the staffing grid issue from T1.
Safety was a Key issue discussed and as Tom Manning pointed out we spent the least amount of time on this issue! Most workers feel that management has not sought out line staff to ask their opinion about any of the knee jerk reactions that have been implemented in the last month or any input at all. Although typical of management we had thought they would realize the huge amount of expertise that staff possess and what an important resource they are.
There appears to be a feeling of disrespect the retreat has towards the union and as a result management has not followed the contract and also has not notified the Union about changes they have made. This disrespect has to come to and end! There is a membership meeting scheduled for September 2, 2008 at 2 and 4 pm. We need you input at this meeting please make a note of the date and time. Look to the Union bulletin boards at the Retreat for more infomation.

We met with management and we would like input from members so we can go back with ideas to improve not only patient safety but Staff safety as well. I believe it is time that we all think outside the box for answers, we need well thought out strategies and not knee jerk reactions. Please come to the meeting and share your thoughts on how to improve safety.

Open letter to Management

On behalf of UNAP 5086, we are writing to express our deep concern about the repeated violations of our contract, primarily in regards to the staffing grids and the grievance procedure. We understand that this administration is new and that everyone may not be well versed in working with a union shop. We also understand that some of the administrators are attempting to follow the contract. Yet this is a binding, legal contract; and the administrations attempts, however sincere, still leave the Retreat out of compliance. Currently we have the following active grievances:

1. T 4 breaks
2. T 2 staffing grid
3. T 3 staffing grid
4. T 1 staffing grid
5. Admissions nurse job change

These grieveances all impact patient and staff safety and the Union will not allow anything but 100% compliance to the staffing grids.

We had hoped that the union and the administration could work cooperatively to make some of the changes that the Brattleboro Retreat needs to make in order to stay alive and flourish. The union is frustrated by the waste of time and energy spent in dispute. We’re working backwards and against everyone’s interests when we have to constantly negotiate contract violations.

The current administration has repeatedly stressed the importance of staff retention here at the Retreat. However when this self same administration walks all over us by blatantly violating the contract instead of approaching us first to discuss needed changes, the members feel disrespected and disinclined to work for this institution.

May Update

The professional issues committee is working on improving T4. Sue Mello thought it was a successful meeting with Vareen. The committee will be meeting again on May 29th to see how the plans are going.

Contracts are in and are being circulated if you need a copy see Mike Barry or Tom Flood.

Elections are due in June and you should be receiving in the mail Information about the Election. Also the budget is up for a vote in June also. Keep tuned for the times and date.

We have a step II grievance that is still going full force and we met with Management on May 16, 2008 to figure it out or move it to step 3. We presented our case and await Managements response. It is a staffing grid issue!

We also have a step III grievance that may go to arbitration, the grievance is centered on breaks. The grievance Committee will meet and discuss what to do next.
The May Day celebration on the commons was small this year but a good time was had by all that attended.

Monday May 19 starts a new orientation group of 11 new members. Please when you meet them introduce yourself and make them feel welcome. Mike Barry and Tom Manning have taken over orientation which happens at 12:30 on Mondays when there is a new class.

UNAP Scholarship

The UNAP scholarships were announced on May 14 at the Executive council meeting in Rode Island and one of the winners was Rachael Dowd. Rachael is the daughter of Ed Dowd who works on the Adolescent inpatient unit. Congratulations Rachael!

Retreat contract signed

The new Retreat contract was signed on Monday, April 7. We are waiting to get the copies back from the printer. As soon as we receive them, we will distribute them to all our members. Stay tuned...
The contract is on the "S" drive if you have access to the retreat computers.

Danielle Perry joins UNAP staff

Former Local 5086 President and Brattleboro Retreat RN, Danielle Perry, is now working with the UNAP in Rhode Island as a union organizer. Danielle's responsibilities include organizing LPNs, Techs, and support staff at Fatima Hospital, where the UNAP already represents RNs, as well as Kent County Hospital, the second largest hospital in Rhode Island.

The contract is all set to go to the printer. We worked hard to make sure the Staffing grids were included in this contract and we were successful.
We have a new communication committee that will begin to disseminate information in the form of a newsletter. Look for it in the mail at mid April. We also will place information in the bulletin boards.
